In regard to "provocation" to attack someone with deadly force (hitting them in the head with a skateboard as hard as possible, telling them you're going to kill them then trying to grab their gun, and pointing a gun at their head) clarity is required.

The DA was trying to convince the jury that "making people mad" because you are simply armed or have done something they don't like or is "frightening" to them, is sufficient "provocation" to try to kill them.

This is a continuation of the 'Crat effort to degrade the culture of our nation and bring it down to the same savage level of sub-Saharan African / Arab culture in which simply "making someone mad" is considered a legitimate excuse for committing violent acts (including homicide) against them*.

In Western culture, there is no law against "making someone mad". There are laws against, "trying to kill someone who is not attacking/threatening you directly through actions, either verbal or overt".

The ignorance of the law is something I deal with every day. People routinely express outrage at a whole spectrum of things which are not illegal. They howl with outrage when their photographs are taken in public (100% legal), are told to stop doing illegal things (using narcotics or controlled substances in public places), loitering on private property without any legitimate purpose, littering, defecating/urinating, engaging in sexual acts/exposing themselves in public places, making threats of violence/challenging others to fight, repairing machinery on private property without authorization of the owners, depositing poisonous chemicals or hazardous waste on private property.

Generally most people believe that they can do whatever they want as long as they have a strong desire or need to do so - and deeply resent being informed that the law disagrees with them.

* In some African and Arab nations, if someone commits violent acts on another and evidence shows that they were provoked by the victim's verbal or overt actions, even if the victim did not physically attack them, the attacker may be acquitted of the charge. This even applies to murder. For example, a man who kills/injures a female partner (fiend, child or wife) because she did or said something that made him very angry, may be acquitted of any criminal liability simply on that basis alone.
