It states that no warrant shall issue except upon probable cause. While the amendment is silent on what probable cause encompasses, in practice it has always meant "that a crime has been, or is being, committed" - not that one may be committed in the future (see "Minority Report").

So the argument must be based upon five amendments; 2, 4, 5, 6 and 14. The 5A declaration must reach into the 6th due to the 2nd and 4th in combination. The 14th, of course, extends that color to bind the states.



Democrats wouldn't buy a clue if it was government subsidized.
